Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to any person or persons who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Our services are based on a subscription basis ("Subscription(s)"). You will be billed on a recurring and periodic basis ("Billing Cycle"). Billing Cycles are set on a monthly basis.
At the end of each Billing Cycle, your Subscription will automatically renew unless you cancel it or CB/I Digital Ltd cancels it. You may cancel your Subscription renewal by contacting the CB/I Digital Ltd customer support team.
CB/I Digital may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial"). You may be required to enter your billing information in order to sign up for the Free Trial.
If you start the Free trial Period, you must cancel it by the end of Free Trial Period to avoid incurring any charges.
On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.
If you upgrade your Plan level, your credit card will immediately be charged a prorated amount reflecting the increased rate, and you will be charged the full amount of the new rate beginning with your next billing cycle.
If you downgrade your Plan level, your credit card will automatically be charged the new rate beginning with your next billing cycle. Downgrading your Plan may cause the loss of account content, features, or capacity. CB/I Digital Ltd does not accept any liability for such loss.
CB/I Digital Ltd, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
CB/I Digital will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
A valid payment method, including credit card, is required to process the payment for your Subscription. By submitting such payment information, you automatically authorize CB/I Digital Ltd to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, CB/I Digital Ltd will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
Certain refund requests for Subscriptions may be considered by CB/I DigitalLtd on a case-by-case basis and granted at the sole discretion of CB/I Digital Ltd.
Features and functionality provided by https://www.conative.ai/ are and will remain the exclusive property of CB/I Digital and its licensors.
Our main way to connect to your AdWords account is via the AdWords API. You may revoke our API access to your accounts by visiting https://security.google.com/settings/security/permissions with a Google account you connected to https://www.conative.ai/
We reserve the right to modify https://www.conative.ai/ at any time, with or without notice to you. We may also terminate or suspend your account immediately if you breach the Terms.
You agree to defend, indemnify and hold harmless CB/I Digital and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
You will be required to create an account and specify a password in order to use our services. When you create an account with us, you must provide us with information that is accurate, complete, and current at all times.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You may not use as a username, the name of another person or entity that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene. You expressly agree that we cannot be held liable for any loss or damage arising out of any misrepresentations you make in this regard.
Except where prohibited, the services entities shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of the sites or any third party’s use of the sites. These exclusions include, without limitation, damages for lost profits, lost data, computer failure, or the violation of your rights by any third party, even if the services entities have been advised of the possibility thereof and regardless of the legal or equitable theory upon which the claim is based.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether expressed or implied, including, but not limited to, the implied warranty of merchantability, fitness for a particular purpose, non-infringement or course of performance.
CB/I Digital, its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
Those terms are governed by the laws of the State of New York ( without regard to its conflict of laws provisions)
